Process

Yes. Once you instruct us, your transaction will be managed by your dedicated conveyancer. We will provide you with their details and these will be visible in our online case management tool too. This person will see your case through from beginning, all the way through to completion. Quite often each conveyancer will schedule calls with you to review your case and ensure progress is being made towards completion.

 

As hard as it is for all parties when a sale falls through, sometimes it happens due to reasons outside of your (or our) control. We have a ‘No Move, No Fee’ guarantee. So if the transaction falls through, you don’t pay our legal fees.

If you are buying with a mortgage, your mortgage provider will require searches to be carried out. They are done to check if there is anything you need to know about the property and that there are no problems for you to be concerned about.

The most common searches obtained on a purchase are a Local Authority search (which details planning and building regulation applications, conservation area and listed building applications, road schemes and environmental issues etc.) and a water and drainage search (to confirm that you are connected to the water mains and sewerage system).

We will also obtain an environmental report. This will detail the likelihood of the property lying on contaminated land and any flooding or subsidence risks or any other environmental issues which may affect the property. Searches are optional for cash buyers, however recommended to ensure clients know the detail of the property and local area.

They are in place to protect the interests of both yourself and your mortgage company, and your mortgage provider will require these searches to be carried out. They serve to highlight any permitted planning requests, flood plains, landslips, conservation areas as well as proposals for new roads, contaminated land or building regulations. (These are to name just a few!) Searches are optional for cash buyers, however, they are recommended to ensure you know the detail of the property and local area and to avoid any surprises later down the line.

Shortly after your instruction, you will receive an email from noreply@conveyltd.co.uk, our online case management system. All you need to do is register your password and complete your starter form, this is where you can add details of additional clients.

You must pay Stamp Duty Land Tax (SDLT) if you buy a property or land over a certain price in England and Northern Ireland. This is a tax controlled and imposed by HM Revenue and Customs’ (HMRC) and it is required by law. Stamp duty is calculated based on varying factors such as property price first time buyers, second/investment property. During your quote, we will calculate the Stamp Duty Land Tax for you and include it in our fee, so that you can see the total amount you will need to pay us with no surprises on your final bill.

We aim to work on an average of 6-8 weeks, however there are many factors that could dictate the length of time required to complete your transaction. For example, the speed at which the solicitors of the other parties respond, findings from searches requiring attention, etc may slow things down. As a loose indication, you may be looking at less than three months if you’re not involved in a chain, while transactions that are within a chain can sometimes take up to six months. This is a tax controlled and imposed by HM Revenue and Customs’ (HMRC), and as such is set by them. During your quote, we will calculate exactly what your Stamp Duty Land Tax (SDLT) charge will be, and we’ll automatically calculate any discount or relief you may be entitled to – for example, you’re a first time buyer.

If you have a mortgage on the property then this fee is for us to take care of the legal work involved in the mortgage. You may find that most other legal firms or solicitors will charge a similar fee.

If you have a mortgage on the property you are selling, then this fee covers the legal work involved in settling the mortgage with your current lender.

If the mortgage lender requires searches we would need to take upfront payment for these so we can order the search packs for you. The nominal fee for these searches is £375 (inc VAT) regardless of property value. If you are not taking a mortgage then the searches are not mandatory, although we would still recommend them for your own peace of mind. If you choose not to take them, the £375 payment will not be required . The other fees will all be payable before completion.

The Stamp Duty land tax fee is our charge for dealing with the Inland Revenue and completing the reports they require. This is included within our quote to you so there are no hidden fees. You may find that other solicitors and legal firms also charge a similar fee.

If you are seeing less expensive quotes then please be sure to check the terms/conditions for hidden/uncapped fees. Some legal firms will give an estimate initially rather than a fixed price, and not everyone will include everything as standard initially – meaning you could face hidden costs on your final bill. Our fee also includes your Stamp Duty Land Tax, so please ensure any other quotes you are receiving also include this amount. Don’t forget that we also strive to offer a five-star service, and we offer a ‘No Move, No Fee’ guarantee.

Help to buy

The first thing to note is that there are two Help to Buy schemes: Help to Buy Equity Loan and Help to Buy ISAs. With a Help to Buy: Equity Loan the Government lends you a percentage of the cost of your newly built home, so you’ll only need a small cash deposit and a mortgage to make up the rest. You won’t be charged loan fees on the Government-lent loan for the first five years of owning your home. With a Help to Buy: ISA, the ISA contains your savings and the Government will contribute towards the property cost based on the ISA type you have. We will work with your ISA provider and retrieve the amount due as part of the help to buy scheme towards the purchase of your property.

Yes. There is a small fee of £60 (including VAT) for each ISA held as they require additional work to be undertaken. You may find that most other legal firms or solicitors will charge a similar fee.
